2. Description of Service
AutoFLeX provides a subscription-based service that tracks, manages, and submits elevator permit renewal requests on behalf of building owners and property managers. Once a renewal request is submitted, clients receive a letter of acknowledgment from the California Department of Industrial Relations, confirming that the current permit remains valid until inspection.
AutoFLeX also provides a QR code system for each elevator, which is placed next to the permit. This QR code links to real-time compliance data, allowing anyone—riders, building managers, or inspectors—to scan the code and instantly view the most current compliance status of the elevator permit. This system addresses the issue of expired permits by ensuring that the latest information is always available, even if the physical permit has not been updated.
AutoFLeX’s responsibility is limited to the submission of the renewal request and providing the QR code for compliance tracking. We do not handle scheduling inspections, performing inspections, or addressing compliance issues raised by the inspector.
3. Subscription and Fees
• Subscription Plans: AutoFLeX offers monthly and annual subscription plans. The fees associated with each plan are displayed at the time of sign-up and may vary based on the number of buildings and elevators under service.
• Payment Terms: Payment is required in advance for all subscription periods. By providing a payment method, you authorize AutoFLeX to charge your payment method for the fees applicable to your selected subscription plan.
• Automatic Renewal: Your subscription will automatically renew at the end of each billing period unless you cancel at least 30 days before the renewal date.
• Fee Changes: AutoFLeX reserves the right to adjust subscription fees at any time. We will notify you of any fee changes at least 30 days in advance.
4. Client Responsibilities
• Accurate Information: You agree to provide accurate and complete information about your building(s), elevators, and permits. This includes ensuring that AutoFLeX receives timely and accurate information for permit renewals.
• Inspection and Compliance: While AutoFLeX submits renewal requests, it is your responsibility to follow up with the state inspector and work with your Elevator Conveyance company to resolve any compliance issues raised during inspections. AutoFLeX is not responsible for inspections, repairs, or ensuring compliance beyond submitting the renewal request.
5. QR Code System
AutoFLeX provides QR codes for each elevator under service. These QR codes display real-time compliance status by linking to our system, allowing anyone to instantly check the most recent information regarding permit status.
• Expired Permits: Even if the physical permit inside the elevator is expired, scanning the QR code will show that the permit is still valid while awaiting inspection, as per the letter of acknowledgment received upon renewal request submission.
• Limitations: The QR code only reflects the most recent data available from the California Department of Industrial Relations regarding permit status. It does not provide information on any compliance issues raised after an inspection.
6. Cancellation and Termination
• Cancellation: You may cancel your subscription at any time by contacting us. If you cancel, your subscription will remain active until the end of your current billing period, and no refunds will be provided for any unused portion of the subscription.
• Termination by AutoFLeX: AutoFLeX reserves the right to suspend or terminate your account if you violate any of these Terms or fail to pay subscription fees. Upon termination, all rights granted to you under these Terms will immediately cease.
7. Refund Policy
All subscription fees are non-refundable unless otherwise required by law. In the event of a billing dispute, please contact us, and we will make reasonable efforts to resolve the issue.
8. Limitation of Liability
AutoFLeX makes every reasonable effort to ensure that permit renewal requests are submitted on time and that clients are notified of the compliance status. However, we cannot guarantee that renewals will always be processed before the permit expires or that inspections will be completed by the state within a particular timeframe.
• Disclaimer: AutoFLeX is not responsible for any penalties, fines, or damages that may result from expired permits, missed inspections, or non-compliance with regulatory requirements.
• Liability Cap: To the fullest extent permitted by law, AutoFLeX’s liability for any claims arising out of or related to the Service is limited to the amount paid by you for the Service during the 12 months preceding the event giving rise to such liability.
